Turnbull Cutting Horses Waiver

Client signs this Agreement voluntarily for and in consideration of TCH allowing Client to participate in equine clinics, training, lessons, competitions, shows, practices, and / or any related or incidental activities. Client agrees to follow all rules and regulations provided by TCH related to these equine activities.

Acknowledgment of Risk: Client knowingly, willingly, and voluntarily acknowledges that horseback riding and related equine activities involve inherent risks and dangers, including without limitation the potential for serious bodily injury, sickness and disease, trauma, accident, collision, permanent disability, paralysis and death; loss of or damage to personal property; the unpredictable behavior of horses and other participants and spectators of varying skill levels; riding and premises conditions and weather; failure of protective equipment; and other undefined or not readily foreseeable risks and dangers.

Assumption of Risk: Client understands that the risks may be caused in whole or in part or result directly or indirectly from the negligence of Client’s actions or inactions or the actions or inactions of others, including TCH, other participants, and spectators, and Client voluntarily and knowingly assumes all risks and responsibility for any damages, liabilities, losses or expenses Client incurs as a result of Client’s participation in equine activities with TCH. Client agrees to be responsible for any injury or damage caused by Client.

Liability Waiver: Client knowingly and voluntarily waives and releases and covenants not to sue TCH and its owners, licensees, employees, agents, contractors, staff, and participants and spectators (Released Parties) from any liability for injury or death, and for damage or loss to Client or Client’s personal property, which may relate in any way to Client’s participation in equine activities with TCH, including any negligence of a Released Party. Client acknowledges and TCH warns that not all risks associated with equine activities can be anticipated or eliminated, even when exercising the utmost care, due to the dangers and conditions which are an integral part of equine activities, and which include the unpredictability of the animal’s reaction to environmental conditions.
Indemnity: If despite this agreement, Client or anyone on Client’s behalf makes a claim for liability against any Released Party, Client agrees to indemnify defend and hold harmless the Released Parties from any liability associated with such claim.

WARNING – Under Colorado law, an equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities, pursuant to section 13-21-119, C.R.S. Arizona law also limits liability of equine professionals.
